It won’t fly

It won’t fly
: Daniel Drezner shows why a constitutional amendment to ban gay marriage won’t get off the ground. Thank goodness, a constitutional amendment is extremely difficult to enact. Threatening one is usually the last, desperate act of a hopeless movement.

: Update: Chris Geidner fisks the NY Times story that says a poll finds “strong support” for a gay marriage ban. [via Atrios]

You are right of course…..but that doesn’t mean some of the far right won’t continue to try.
Which gives some of us VRWC members a bad name.

There are three ways to amend the Constitution, 2 of which are extremely difficult, the other much less so. Rather than convening a Constitutional Convention, or having 3/4 of the states and 2/3 of both houses of Congress approve a proposed amendment, proponents of a constitutional amendment need only get 5 justices of the Supreme Court to agree with their position.
That, in a nutshell, is why the courts are, and always will be, highly politicized.
